1. General Provisions These Terms and Conditions (hereinafter referred to as the "Terms") govern the procedure for using the ZIBINATI Couturier website (hereinafter referred to as the "Site"), as well as the procedure for placing orders, paying for, delivering and returning goods posted on the Site https://zibinati.com By accessing the Site and/or placing an order, the Visitor confirms their agreement with these Terms.

2. Legal Capacity andAge Restrictions Access to the Site and placing orders are permitted exclusively to individuals who have reached the age of 18 (eighteen years) and have full civil capacity in accordance with the provisions of Article 34 and Article 35 of the Civil Code of Ukraine.

3. Intellectual property All materials posted on the website, including texts, images, design elements, logo, corporate identity, photographs and software are the intellectual property of the owner of the ZIBINATI Couturier website. Copying, reproduction, distribution, publication, transfer to third parties or other use of materials from the website without the prior written permission of the copyright holder is prohibited and may entail liability established by the legislation of Ukraine, including the Law of Ukraine "On Copyright and Related Rights".

4. Registration and personal data

4.1. Registration may be required to place an order and/or access certain functions of the website. The user undertakes to provide accurate and up-to-date data when registering and using the website.

4.2. The user is fully responsible for the safety of their registration data and for all actions performed under their account.

4.3. By providing personal data, the user confirms consent to their processing in accordance with the Privacy Policy posted on the website.

5. Placing orders and payment The Buyer places an order independently through the Website interface. Information about the products, their availability, price and delivery terms is current at the time of placing the order. Payment is made using methods available on the Website. The Seller reserves the right to cancel the order in the event of technical failures, errors or other objective reasons, of which the Buyer will be promptly informed. Custom orders (including custom tailoring, model changes, personalization) are placed by prior agreement between the Buyer and the Seller via instant messengers or other communication channels specified on the Website. The cost and terms of fulfillment of a custom order are calculated individually and confirmed by the Seller before execution. Production begins after 100% prepayment, unless otherwise agreed by the parties.

6. Dispatch and delivery The standard delivery time for goods is from 1 to 3 business days from the date of confirmation of payment for the order. In the case of custom tailoring, high production load, limited availability of materials or other objective reasons, the delivery time may be extended. The estimated date of order fulfillment will be communicated to the buyer via instant messengers (Telegram, Viber, WhatsApp), by phone or email. By placing an order, the buyer confirms his/her consent to the possibility of extending the fulfillment period in the presence of the above reasons. After the order is transferred to the logistics company, responsibility for meeting the delivery deadlines passes to the transport service. The seller is not responsible for possible delivery delays.

7. Returns and exchanges Returns and exchanges of goods are carried out in the manner and within the timeframes stipulated by the Law of Ukraine "On the Protection of Consumer Rights", as well as other applicable regulatory legal acts. Custom-made goods (including tailoring according to individual measurements, model changes, personalization) are not subject to return, except in cases of identified manufacturing defects. The customer is responsible for the accuracy of the provided parameters (measurements, wishes for the model and other individual characteristics). Returns are not accepted if the product corresponds to the specified data. In case of questions related to return or exchange, the buyer can contact us via the contact form on the website, instant messengers (Telegram, Viber, WhatsApp) or by phone.

8. Warranties and liability The website and the services provided through it are offered on an "as is" basis. The seller does not provide any additional warranties other than those provided by law. In the event of technical failures or temporary unavailability of the website for reasons beyond the control of the seller (such as interruptions in the hosting, Internet connection, software and other technical malfunctions), obligations under already placed orders remain. However, temporary delays in providing access to information on the website or in placing new orders are possible.

9. Dispute resolution All disputes and disagreements arising in connection with the implementation of these Terms and Conditions shall be resolved through negotiations. If it is impossible to reach an agreement, the dispute shall be considered in the manner prescribed by the current legislation of Ukraine.

10. Changes to the Terms and Conditions The Seller has the right to make changes to these Terms and Conditions without prior notice. The updated version is published on the Site and applies from the moment it is posted. The User agrees to the changes by continuing to use the Site after their publication.
